What personal information do we collect?  The data we process is data collected from:

-       The forms that you fill in and the requests you make. For example, requests for information about our properties or brokerage services, or requests about purchases or rentals.

-       Information generated by providing these services.

 

The data categories that we process typically consist of:  

-       Identification details.

-       Personal information.

-       Contact details, postal and email addresses.

-       Financial information and information about transactions.

 

Why do we process your data? Your data will be processed in order to fulfil our contract with you, to comply with our legal obligations and to send you marketing information.

Who will we share your data with? We will only share your data where we have a legal requirement to do so, when it is necessary to provide the services requested or where we have your prior consent. The recipients of information can include, among others, the tax authorities, other public bodies, public registers and/or notaries.

If the properties relating to your requests are located within the territorial area covered by another agency or agencies within Mallorca Modern, your data will be shared with them. 

Legal basis for processing. The processing of your data is based on the execution of a contract and compliance with our legal requirements, in particular Act 10/2010, on preventing money laundering, and accounting and tax legislation.

Sending out marketing information is based on our legitimate interest in promoting our services. 

How long will we store your data for? Your data will be kept for the duration of your relationship with us and, in all cases, for the time period established in the applicable legal provisions and for the length of time necessary to deal with any liabilities arising from processing the data. We will erase your data when it is no longer necessary or relevant for the purposes for which it was collected. Data processed for commercial purposes will be kept active until its erasure is requested. 

What are your rights? You have the right to obtain information about whether or not we are processing your personal data and if we are, to access your data. You can also request your data to be rectified when it is inaccurate or to complete incomplete data, as well as request its erasure when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

In certain circumstances, you may request your data to be restricted. In such cases, we will only process the affected data for making or defending complaints, or with a view to the protection of other people’s rights. Under certain conditions and for reasons related to your particular situation you may also object to your data being processing. In this case we will stop processing your data except where there are legitimate overriding reasons that prevail over your interests, rights and freedoms, or for making and defending complaints. Under certain conditions you can also request the portability of your data in order for it to be sent to a different data controller.   

You can withdraw the consent that you have given for certain purposes without this affecting the legality of the processing based on the consent given prior to its withdrawal and you can present a complaint to the Spanish Data Protection Agency.

To exercise your rights, you must send us your request along with a copy of your national identity document or any other valid ID document by post or email to the addresses listed in the section “Who is responsible for processing your data?”
